About the Waivers
Florida maritime law requires a signed liability waiver from every passenger before boarding. Each person in your group will complete their own waiver as part of this booking form — no separate paperwork needed on the day of your charter. If your group includes minors, a parent or guardian must complete a separate Minor Passenger Assumption of Risk & Release for each child.
Cancellation, Payment & Refund Policy
A 50% deposit is required at the time of booking to secure your charter date. The remaining balance is due 48 hours prior to departure.
Cancellations made 14 or more days before the charter date will receive a full refund of the deposit. Cancellations made 7–13 days before the charter date will receive a 50% refund of the deposit. Cancellations made fewer than 7 days before the charter date are non-refundable.
In the event of cancellation due to unsafe weather conditions as determined solely by the captain, you will receive a full refund or the option to reschedule at no additional charge.
No-shows or cancellations on the day of the charter are non-refundable. Rescheduling requests are subject to availability and must be made at least 48 hours in advance.
Passenger Liability Waiver
By submitting this booking request, you acknowledge that boating activities involve inherent risks, including but not limited to rough water, inclement weather, slippery surfaces, and the movement of the vessel. You voluntarily assume all such risks on behalf of yourself and all members of your party.
You agree to release, indemnify, and hold harmless The Blue Retreat, its owners, operators, crew, and agents from any and all claims, damages, losses, or expenses arising out of or in connection with your participation in the charter, except in cases of gross negligence or willful misconduct.
All passengers are required to follow the instructions of the captain and crew at all times. The captain reserves the right to refuse service or terminate a charter early if any passenger's behavior poses a risk to the safety of others, without refund.
Life jackets are available for all passengers and are required to be worn by all children under 13 years of age at all times while on board, in accordance with Florida law.
Minor Passenger Policy & Waiver
Passengers under 18 years of age must be accompanied by a parent or legal guardian at all times during the charter. The accompanying adult accepts full responsibility for the safety and conduct of all minor passengers in their care.
All minor passengers under 13 years of age are required to wear a properly fitted U.S. Coast Guard-approved life jacket at all times while on board, as required by Florida Statute 327.50.
A separate Minor Passenger Assumption of Risk & Release must be completed by the parent or natural guardian for each minor passenger before boarding.
